1. General
These Terms of Service govern all purchases made through the Essence Activewear online store. By placing an order, you confirm that you have read and agree to these terms.
Essence Activewear is based in the Netherlands.
2. Pricing & VAT
All prices are displayed in EUR, GBP, USD, and AUD and are inclusive of VAT where applicable, in accordance with Dutch and EU regulations. Prices are subject to change without notice. The price confirmed at checkout is the price you will be charged.
3. Orders & Payment
Your order is confirmed upon receipt of an order confirmation email. We reserve the right to refuse or cancel any order at our discretion, including in cases of pricing errors, stock unavailability, or suspected fraudulent activity. In such cases, you will be notified and any payment taken will be refunded in full.
4. Product Representation
We make every effort to display our products as accurately as possible. However, colours may vary slightly from the images shown on screen due to differences in monitor calibration and lighting conditions. Size guides are provided for reference only and are indicative — fit may vary between styles.
5. Shipping & Customs
Delivery times are estimates and may be affected by customs clearance or carrier delays outside our control. Customs fees, import duties, and taxes are the sole responsibility of the customer. Essence Activewear is not liable for delays or additional charges incurred at customs.
6. Right of Withdrawal (EU Consumers)
Customers based in the European Union have a statutory right of withdrawal of at least 14 days from the date of delivery, in accordance with EU Directive 2011/83/EU. To exercise this right, contact us at support@essenceactivewear.com within the applicable period. Statutory exceptions apply.
7. Returns & Refunds
Returns and refunds are handled in accordance with our Return & Refund Policy, which forms part of these Terms of Service.
8. Liability
Essence Activewear's liability is limited to the value of the order placed. We are not liable for indirect, incidental, or consequential damages arising from the use of our products or website.
9. Privacy
We process personal data in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR). Your data is used solely for order fulfillment and communication purposes.
10. Complaints
For any questions or complaints, please contact us at support@essenceactivewear.com. We aim to respond within 5 business days. Unresolved complaints may be submitted to the Dutch Consumer Authority (ACM ConsuWijzer) or via the EU Online Dispute Resolution platform at ec.europa.eu/odr.
11. Governing Law
These Terms of Service are governed exclusively by Dutch law. Any disputes shall be brought before the competent court in the Netherlands.
